Digital products, archive packages, licenses, and cooperation.
These Terms & Conditions govern the sale and delivery of digital products, e-books, PDFs, EPUB files, datasets, archive packages, licenses, and related cooperation services provided under the MAYAN ALFA framework.
All listed products are delivered electronically. For digital content, once access or download begins with the customer’s explicit consent and acknowledgment of the loss of the right of withdrawal, the performance is non-refundable to the extent permitted by applicable law.
Seller
The seller is David Hess, MAYAN ALFA, with registered office at Křižanov 39, 789 01 Hynčina, Czech Republic, Company ID 08965846, e-mail david.hess@mayanalfa.com. The seller is not a VAT payer unless a specific offer states otherwise.
Scope and definitions
These terms apply to e-books, PDFs, EPUB files, datasets, archive packages, ZIP/CSV/TXT files, access links, licenses, individual cooperation, and other digitally confirmed performance. The offer is digital only.
- Digital product A file, package, access link, or digital material delivered electronically.
- Dataset A structured set of data, metadata, checksums, manifests, reports, or archive files.
- E-book A digital book, explanation, methodology text, or publication delivered electronically.
- Cooperation Custom work, consulting, archive preparation, licensing, or research-related support agreed separately.
Order and contract formation
An order is an offer to conclude a contract. The contract arises by order confirmation, acceptance of payment, or another express acceptance by the seller.
The seller may reject an order that is incomplete, technically problematic, abusive, or contrary to these terms. If immediate digital access is requested, the buyer must confirm consent to performance before the withdrawal period expires and acknowledge the related loss of withdrawal rights.
Prices and payments
Prices are stated with the product or service offer and are binding at the moment the order is submitted unless expressly stated otherwise.
Payment may be made by card, payment gateway, Apple Pay, Google Pay, bank transfer, or another method stated in the offer. Digital access is granted only after the full price has been credited unless otherwise agreed.
Delivery of digital content
Digital products are delivered electronically through a download link, account access, e-mail attachment, or direct file access. No physical transport, packaging, or postal delivery is provided.
The buyer should check link functionality, file integrity, version correctness, and package completeness after delivery. If a checksum, manifest, or version identifier is provided, that identifier is decisive for conformity.
Digital products and datasets
Digital products, e-books, datasets, and archive packages may include manifests, checksums, README files, version notes, reports, or license files.
After opening a link, starting a download, or accessing the file, the customer must respect the product’s license regime and may not redistribute, sublicense, upload publicly, or republish the material unless the license expressly allows it.
Withdrawal from contract
For digital content, e-books, datasets, archive packages, and other electronically delivered files, the right of withdrawal does not apply after performance has started if the buyer has expressly consented in advance and acknowledged the loss of that right.
If digital content is defective or was not properly made available, rights from defective performance remain preserved.
Complaints and defects
A defect may include a non-working link, damaged file, missing part of a dataset, wrong version, wrong title, or incomplete package.
Depending on the defect and applicable law, the seller may provide repair, replacement access, file substitution, link re-send, reasonable discount, or refund.
Licenses and copyrights
Unless expressly stated otherwise, the buyer receives a non-exclusive, non-transferable, and non-sublicensable license for personal or internal use within the scope stated for the specific offer.
- Prohibited Further distribution, resale, sublicensing, public uploading, scraping, reverse engineering, AI training without consent, or bypassing access controls.
- Permitted Quotation, linking, citation, and use within statutory license exceptions.
- Specific license prevails The product page, license file, DOI record, or individual agreement prevails if it is more specific and not contrary to law.
Cooperation and custom work
Cooperation, consulting, custom data, adapted archives, or individual licenses arise only on the basis of a written agreement, offer, order, or e-mail confirmation with a defined scope, deadline, price, and outputs.
Without written confirmation, no exclusivity, joint venture, agency, or other special relationship arises.
Liability and operations
Content, methodology, data, and publications are provided “as is” to the extent permitted by law. The seller does not guarantee compatibility with all software, hardware, readers, scripts, or third-party systems unless explicitly promised.
Access may be temporarily limited for technical reasons, maintenance, security, or obvious misuse.
Consumer and business customer
If the buyer acts as a consumer, mandatory consumer-protection rules apply. If the buyer acts as a business customer, the written offer and these terms apply unless otherwise agreed.
For business orders, confidentiality, due dates, acceptance, source handoff, NDA, license scope, or exclusivity may be agreed separately.
Boundaries of claims and public release
MAYAN ALFA is an independent computational observation framework and deterministic benchmark comparison system. Public results must be read as bounded observations under documented hardware, software, workflow, and archive conditions.
The project must not be presented as a universal theory, a guaranteed replacement for established prime sieves, a cryptographic assurance library, or a source-code release of protected internal logic.
- Allowed public framing Independent computational observation framework, deterministic benchmark comparison system, bounded 10M–10B public evidence package, structured release methodology, and ARM64-oriented performance observation workflow.
- Prohibited public framing Universal theory, guaranteed mathematical claim, cryptographic certainty tool, replacement for established prime sieves, or publication of protected core logic.
- Public data boundary Public, GitHub, and Zenodo materials are limited to public-safe documentation and approved 10M–10B benchmark evidence.
- Controlled data boundary 100B and higher materials belong to controlled archive layers and must not be redistributed without written permission.
Product regime by type
The summary below serves as an interpretive guide for how individual product types are assessed.
- E-book Digital content; after download or access begins with explicit consent and acknowledgment of the loss of withdrawal rights, the performance is non-refundable to the extent allowed by law.
- Dataset, ZIP, CSV, archive package Electronically delivered licensed material; no further distribution, sublicensing, public uploading, or repackaging unless expressly allowed.
- Consulting and cooperation Binding only after written agreement; scope, term, price, revisions, acceptance, and handoff are governed by the order.
Final provisions
Legal relations are governed by the laws of the Czech Republic and applicable European Union regulations. The parties will first attempt to resolve any dispute amicably.
A consumer may also contact the Czech Trade Inspection as part of out-of-court consumer dispute resolution. If any provision is invalid or ineffective, the remaining provisions remain unaffected.
The wording of the product page, license file, DOI record, offer, or e-mail confirmation prevails over this general text if it is more specific and not contrary to law. The seller may amend these terms; changes apply to future contracts from the moment of publication.
